Why Inventors Trust iPatentPending™

The good news is the answer is NO!

Due to an international agreement called the Paris Convention, (which nearly every country in the world is signed up to), if you file your provisional patent application at the USPTO (USA), you can use that USA provisional patent application as a BASIS FOR PRIORITY when filing your FULL (non-provisional) patent application(s) almost anywhere in the world, including all the main patenting territories.

So your USPTO provisional patent application can be used as a ‘priority document’ when it comes to trying to get European patent protection, for example, or Japanese patent protection.

And it works the other way round as well- so if a (provisional) patent application is filed in any ONE of the countries signed up to the Paris Convention agreement, it can be used as a BASIS FOR PRIORITY if you file at any OTHER one or more of the other countries if you file at them within 12 months of that initial (provisional) patent application. Great, right?

The key requirement is that you must file your full non-provisional patent application(s) WITHIN 12 MONTHS of your (USPTO) provisional patent application filing date. (This also applies to the deadline for filing a PCT application).

This is great news for you as the inventor! You only need to file your provisional in ONE territory and can then use it as a basis for priority in all your later filed non-provisional patent applications in different territories!

No!

This is great news. The patenting term for different ‘versions’ of your invention is different ‘EMBODIMENTS’ of your invention, and it’s very normal to have many, many different embodiments (ie many different ‘versions’) of the invention in just one patent application.

In fact, there are actually many POSITIVES to filing a patent application that discloses many different versions of the invention. Here are the top two benefits:

  • If you get a ‘broad’ claim patented, (ie get broad patent protection granted), it’s considered very good to have lots of different versions of the invention in the application that are within the scope of that ‘claim’, because it will be clear that all those different versions are protected by that broad granted patent. It also shows you’ve ‘anticipated’ all those different versions. (In fact, having lots of different ‘versions’ of the invention, all within the broad scope of what you’re trying to claim/patent is sometimes referred to as ‘filling the claim scope’. So there’s even a ‘term’ for this, and it’s considered to be part of diligent and good quality patent application drafting).
  • Filing just one provisional patent application (rather than many) makes things a lot more simple in terms of ‘priority date’ claiming because when it comes to filing a later non-provisional patent application, it can claim priority back to just ONE provisional patent application/date, rather than many.

 

So the good news is, your provisional patent application can include many different versions of your invention! That can even be a GOOD thing!
